(n) 12-49 BUY AMERICAN.
(1) DEFINITION OF DOMESTIC COMMODITY OR PRODUCT. In this subsection, the term domestic commodity or product means (A) an agricultural commodity that is produced in the United States; and (B) a food product that is processed in the United States substantially using agricultural commodities that are produced in the United States.
(2) REQUIREMENT.
(A) IN GENERAL. Subject to subparagraph (B), the Secretary shall require that a school food authority purchase,to the maximum extent practicable, domestic commodities or products.
(B) LIMITATIONS. Subparagraph (A) shall apply only to (i) a school food authority located in the contiguous United States; and (ii) a purchase of a domestic commodity or product for the school lunch program under this Act or the school breakfast program under section 4 of the Child Nutrition Act of 1966 (42 U.S.C. 1773).
(3) APPLICABILITY TO HAWAII. Paragraph (2)(A) shall apply to a school food authority in Hawaii with respect to domestic commodities or products that are produced in Hawaii in sufficient quantities to meet the needs of meals provided under the school lunch program under this Act or the school breakfast program under section 4 of the Child Nutrition Act of 1966 (42 U.S.C. 1773).
(4) 12-49A APPLICABILITY TO PUERTO RICO. Paragraph (2)(A) shall apply to a school food authority in the Commonwealth of Puerto Rico with respect to domestic commodities or products that are produced in the Commonwealth of Puerto Rico in sufficient quantities to meet the needs of meals provided under the school lunch program under this Act or the school breakfast program under section 4 of the Child Nutrition Act of 1966 (42 U.S.C. 1773).

미국학교급식법 12조 n항
(n) 미국산 구매(12-49)
(1) 국내산 상품 또는 가공품의 정의 : 여기에서 국내산 상품 또는 가공품이란 (A)미국 내에서 생산된 농산물과 (B)실질적으로 미국산 농산물을 원료로 미국에서 생산된 가공식품을 말한다.
(2) 의무사항
(A) 공통사항 (B)호에 해당되는 경우 농무부장관은 학교급식위원회로 하여금 실질적으로 최대한 국내산 농산물 및 가공식품을 구매하도록 요구해야 한다.
(B) 적용범위 (A)호는 다음의 경우에 한해 적용된다. (ⅰ)미합중국 본토에 위치한 학교급식위원회. (ⅱ) 본(학교급식법)법에 근거하여 시행되는 점심급식 프로그램과 1996년 아동영양법 제4조에 근거하여 시행되는 아침급식프로그램에 사용되는 국내산 농산물 및 가공식품의 구매
(3) 하와이주에 대한 적용 위 (2)의(A)호는 하와이 소재 학교급식위원회에는 다음과 같이 적용한다. 본(학교급식법)법에 근거하여 시행되는 점심급식 프로그램과 1996년 아동영양법 제4조에 근거하여 시행되는 아침급식프로그램에 의해 제공되는 급식에 소요되는 충분한 양을 하와이에서 생산된 농산물 및 가공식품으로 사용하도록 한다.
(4) 푸에르토리코에 대한 적용 (12-49A) 위 (2)의(A)호는 푸에르토리코 공화국 소재 학교급식위원회에는 다음과 같이 적용한다. 본(학교급식법)법에 근거하여 시행되는 점심급식 프로그램과 1996년 아동영양법 제4조에 근거하여 시행되는 아침급식프로그램에 의해 제공되는 급식에 소요되는 충분한 양을 푸에르토리코 공화국에서 생산된 농산물 및 가공식품으로 사용하도록 한다.

미국학교급식법의 국내산(Buy American)사용규정 변천 내용
○ 미국은 국내농산물의 소비촉진과 안전성을 확보하기 위한 조치로 각종 급식프로그램에 지원되는 급식재료를 미국산 농산물로 제한
- 1988년부터 현물지원 규정(CFR7. 250.23조)에 의해 각종 급식프로그램에 지원하는 모든 농산물과 가공식품 조달시 미국산만 구매토록 규정
∙단, 물량부족, 품질불량, 현저한 가격차이 등 특별한 경우 예외 적용
○ 1998년 10월31일, 학교급식법(NSLA)을 개정하여 농무부의 현물지원뿐만 아니라 학교에서 자체 조달하는 농산물 등 학교급식에 사용되는 모든 급식재료를 미국산 농산물 및 가공식품을 사용토록 제한
- 미국산 농산물 및 미국산 농산물을 원료로 한 가공식품만을 사용토록 하는 조항 추가 (12조 n항)
○ 2002년 5월13일 ‘2002년 농업법(Farm Bill)’을 제정하면서 학교급식에 자국산 농산물을 사용하도록 하는 Buy American 조항을 더욱 강화함
- 적용구역 확대 : 학교급식에서의 자국산 농산물 사용 의무 적용대상 지역이 기존에는 미국본토와 하와이주에 한정되었는데, 2002년 농업법 제정으로 인해 푸에르토리코(Puerto Rico)공화국까지 확대
※ 푸에르토리코는 괌, 버지니아군도 등처럼 영토권과 시정권(施政權)이 동시에 미치는 미국 속령이 아니고, 시정권만 미치는 준독립국가임에도 불구하고 Buy American 규정을 적용
※ 이는 주변 중남미 국가들로부터의 농산물수입을 차단하기 위한 조치로 판단됨
- 자국산보다도 더욱 강한 지역산 농산물 개념 도입 : 급식재료로 지역산 농산물을 사용하도록 자금지원 등 다양한 정책적 지원을 새로 시작
∙고아원, 보호소(Care Center) 등 학교 이외의 비영리기관(institution)들에 대해서 지역산 농산물의 최대 사용을 권장하도록 농무장관에게 책무를 부여
∙기관들이 지역산 농산물 구매에 필요한 시설․장비를 갖추는데 소요되는 초기비용을 지원하도록 2003～2007 회계연도 중 매년 40만달러의 예산을 책정
